Selling an Inherited San Diego Home: Trust vs. Probate

Selling an inherited home rarely starts where people expect.
Most families come to us ready to list, sometimes with a buyer already interested, but agreeing to sell isn’t the same as having the legal authority to sell.
Someone has to have the legal right to sign first, and how you get it depends entirely on one thing: whether the home was held in a trust or has to go through probate.

The smoother path is when the home is already in a trust. If your loved one set up a revocable living trust and placed the home in it, you generally skip probate entirely. The person named as successor trustee, often a family member, steps in with the authority to sell directly, without going to court.
There are still steps:
- notifying the beneficiaries;
- a window for anyone to raise concerns; and
- updating the title.
But functionally, it resembles a normal home sale. Many families reach the market within weeks and wrap up in roughly one to three months. This is exactly why attorneys urge people to set up a trust while they’re living. It saves the family enormous time, cost, and stress later.
The harder path is probate, when there was no trust. If the home was in your loved one’s name alone, the court has to formally appoint someone as executor or administrator and grant them authority before anyone can sell. It’s very doable; families do it every day, but it takes longer and costs more.
In California, probate commonly takes nine to 18 months. A few things help: once the court issues authority, often a matter of weeks, you can usually list and sell even while the rest of the estate settles, and depending on the authority granted, the sale may or may not need a final court confirmation.
There’s also a newer California law that created a faster, streamlined path for a primary residence valued up to $750,000, though in San Diego many homes sell for well above that and still require full probate. This is where a good probate attorney is worth their weight in gold, and it should be your first call.
The taxes are often friendlier than people fear. Many people who inherit a home assume they’ll owe enormous capital gains based on how much it appreciated over the decades their parents owned it. Usually that’s not how it works, thanks to the step-up in basis.
In simple terms, the home’s value for tax purposes generally resets to what it was worth on the date your loved one passed, not what they paid decades ago. So if you sell fairly soon after, there may be little or even no taxable gain.
We’re not tax advisors, and every situation is different, so confirm with your CPA. We mention it because so many families carry stress about a tax bill far smaller than they imagine.
So the real first step in selling an inherited home isn’t listing it. It’s figuring out which path you’re on and getting a good attorney in your corner early.
